How To Remove Car Hypothecation From RC After Loan

When you buy a car through a bank or finance company, the lender’s name is recorded on the Registration Certificate (RC) as the financier. Even after you pay the final EMI, this hypothecation entry does not necessarily disappear automatically.

After the car loan is completely repaid, you should formally apply for Hypothecation Termination (HPT) so that the lender’s name is removed from the RC. The process can generally be started through the government’s VAHAN/Parivahan portal, although document submission or an RTO visit may still be required depending on the state.

How To Remove Car Hypothecation From RC After Loan

Step 1: Make Sure the Car Loan Is Completely Closed

Before applying for removal of hypothecation, confirm that the lender has received the entire outstanding loan amount.

Check that:

  • all EMIs have been paid;
  • no overdue amount remains;
  • foreclosure charges, if applicable, have been cleared;
  • no late-payment or other loan charges remain;
  • the lender has marked the loan account as closed.

Do not begin the RC hypothecation-removal process merely because the last scheduled EMI has been debited. First obtain confirmation from the lender that no dues remain.

Step 2: Obtain NOC From the Bank or Finance Company

Once the loan is closed, ask the lender for a No Objection Certificate (NOC) or loan closure/no-dues certificate.

The NOC confirms that the lender has no objection to removal of its hypothecation interest from the vehicle registration record.

Parivahan lists a financier’s due-clearance certificate and, where applicable, the financier’s NOC among the documents used for hypothecation termination.

Check the document carefully to make sure that details such as the following are correct:

  • vehicle registration number;
  • owner’s name;
  • loan account details;
  • chassis number, where mentioned;
  • financier’s name.

Keep both physical and scanned copies.

Step 3: Get Form 35 From the Lender

Form 35 is the main statutory document used for termination of a hire-purchase, lease or hypothecation agreement.

Under Rule 61 of the Central Motor Vehicles Rules, an application for termination of hypothecation is made in Form 35 and is signed by both the registered vehicle owner and the financier.

Banks and finance companies commonly provide signed Form 35 documents when the vehicle loan is closed.

Check that:

  • your name is correct;
  • vehicle number is correct;
  • financier details are correct;
  • the lender has signed or authenticated the required section;
  • you have signed wherever the registered owner’s signature is required.

Form 35 is normally prepared in duplicate. The official form also provides for a triplicate copy where the original registering authority is different.

Step 4: Keep the Required Documents Ready

The exact document requirement can vary slightly between states and RTOs.

For a normal car-loan hypothecation termination, keep the following ready:

  • Form 35;
  • financier NOC/no-dues certificate;
  • Registration Certificate;
  • valid motor insurance certificate;
  • valid Pollution Under Control certificate, where applicable;
  • owner’s address proof, if required;
  • PAN/Form 60-related document, if required;
  • chassis and engine pencil print, if required by the concerned RTO;
  • owner identification/signature proof, where required.

Parivahan specifically notes that some supporting documents, including address proof, PUC, PAN-related documents, chassis/engine pencil prints and signature identification, may be required depending on the state.

Therefore, check the document list displayed by VAHAN for your vehicle and registering authority rather than assuming that every state follows an identical checklist.

Step 5: Open the VAHAN Vehicle Services Portal

The hypothecation-removal application can generally be started through Parivahan’s VAHAN vehicle-related services.

After opening the vehicle services portal:

  1. select the vehicle-related services option;
  2. enter your vehicle registration number;
  3. select the appropriate state and RTO if requested;
  4. proceed to the available RC-related services.

The exact page design can change, but the service you need is called Hypothecation Termination or HPT.

Parivahan’s current vehicle-services system specifically includes Hypothecation Termination among its RC/vehicle-related services.

Step 6: Verify the Vehicle Through OTP

The portal may ask you to enter details such as:

  • vehicle registration number;
  • chassis number or its last few characters;
  • registered mobile number.

An OTP is then sent to the mobile number linked with the vehicle record.

Enter the OTP to continue.

Parivahan’s current hypothecation-termination instructions require the registration and chassis details followed by OTP verification before the HPT service is selected.

If the mobile number in VAHAN is outdated, you may first need to use the mobile-number update facility available through the portal.

Step 7: Select “Hypothecation Termination”

After vehicle verification, select:

Hypothecation Termination

The portal will display the existing financier or hypothecation information recorded against the vehicle.

Check that the financier shown on VAHAN matches the lender whose loan you have closed.

Proceed with termination of that hypothecation entry.

If the portal does not show the hypothecation information even though it appears on your RC, the record may require correction or assistance from the concerned RTO before you can complete the online process.

VAHAN itself lists availability of hypothecation data in the system as one of its pre-checks for the service.

Step 8: Enter or Update Insurance Details

VAHAN may require you to enter or confirm current insurance information before proceeding.

Provide the required policy details accurately.

The official VAHAN hypothecation-termination workflow specifically includes updating insurance information before document upload and payment.

Make sure the policy is valid and that the registration number and other vehicle details match.

Step 9: Upload Form 35, NOC and Other Documents

If document upload is enabled for your RTO, upload clear scanned copies of the documents requested by the portal.

These may include:

  • Form 35;
  • lender NOC;
  • RC;
  • insurance certificate;
  • PUC;
  • identity/address documents.

Do not upload blurred photographs or incomplete documents. The lender’s seal, signature and important vehicle details should be clearly readable.

The documents requested on screen may differ according to the state or registering authority.

Step 10: Pay the Applicable Hypothecation Termination Fee

After completing the application details, open the fee section.

Review the amount displayed and make the online payment using the available payment method.

Rule 61 requires the application to be accompanied by the appropriate fee specified under Rule 81 of the Central Motor Vehicles Rules.

The amount shown to you may include applicable RC, smart-card or state-specific charges. For that reason, the amount generated by the official VAHAN portal for your particular application should be treated as the relevant payable amount rather than relying on a generic figure found elsewhere.

Save the payment receipt.

Step 11: Book an RTO Appointment If Required

Whether the entire process can be completed online depends on the state and RTO.

Some jurisdictions provide more extensive faceless services, while others may require the vehicle owner to:

  • book an appointment;
  • visit the RTO;
  • submit original Form 35;
  • provide the lender’s NOC;
  • submit or show the original RC;
  • complete document verification.

Parivahan’s official instructions state that document upload and appointment booking are performed where configured, after which the application is forwarded to the RTO for further processing.

Follow whatever instructions appear on your application receipt.

Step 12: Submit Original Documents at the RTO If Asked

If physical submission is required, take the original documents along with photocopies and the online application receipt.

Carry at least:

  • original RC;
  • original lender NOC;
  • signed Form 35;
  • insurance certificate;
  • PUC certificate;
  • application/payment receipt;
  • identity and address proof if requested.

The RTO will verify that the loan agreement has ended and that the financier has consented to removal of the hypothecation entry.

Once approved, the hypothecation termination is recorded in the vehicle-registration database.

Step 13: Check the Updated RC

After the application has been approved, check your updated vehicle details.

The lender’s hypothecation entry should no longer appear against the vehicle.

Depending on the system followed in your state, an updated/fresh RC may be issued or the electronic registration record may be updated.

VAHAN’s internal registration procedure provides for approval of hypothecation termination and processing of the updated registration certificate after approval.

Check the digital RC details as well as any new physical RC received from the transport department.

Do not assume the process is complete merely because you submitted Form 35. Confirm that the financier’s name has actually been removed from the registration record.

Why Should You Remove Hypothecation After Closing the Car Loan?

Removing hypothecation establishes in the registration record that the lender no longer has a financing interest in the car.

Leaving an old hypothecation entry may create unnecessary complications when you later want to:

  • sell the vehicle;
  • transfer ownership;
  • obtain certain RTO services;
  • deal with insurance or registration documentation;
  • establish that the vehicle loan has been fully discharged.

It is therefore better to complete HPT soon after receiving the loan-closure documents instead of leaving the financier’s name on the RC for years.

What If the Bank Has Not Given Form 35 or NOC?

Contact the lender’s vehicle-loan department and request formal loan-closure documents.

Provide your:

  • loan account number;
  • vehicle registration number;
  • identity details;
  • final repayment information.

Do not try to remove a valid hypothecation entry without the lender’s confirmation merely because you believe the loan has been repaid. Under the normal procedure, Form 35 requires the involvement of both the registered owner and financier.

If the original lender has merged with another bank or company, contact the successor institution that now maintains the loan records.

Can Hypothecation Be Removed Completely Online?

It depends on the state and RTO.

VAHAN allows the application, document upload and fee-payment process to be handled online where those facilities are enabled. However, some registering authorities may still require an appointment or physical document submission.

Therefore, completing the online payment does not always mean that the process is finished.

Check the status and instructions shown against your VAHAN application.

Does Hypothecation Get Removed Automatically After the Last EMI?

Normally, you should not assume that it will.

Loan closure takes place in the lender’s records, while removal of hypothecation from the RC is an RTO registration process.

After closing the loan, obtain the lender’s NOC and Form 35 and complete the Hypothecation Termination process through VAHAN/RTO.

Can You Sell the Car Without Removing Hypothecation?

An existing hypothecation entry can complicate ownership transfer because the registration record continues to show the financier’s interest in the vehicle.

If the loan has already been repaid, the cleaner approach is to complete hypothecation termination first and confirm that the updated RC no longer shows the financier before proceeding with the sale.
